Terms of use

1. Provider and scope

These terms apply between you and the provider of Daynori:

They govern the use of the Daynori app. By downloading or using the app you enter into a user agreement with us under these terms. Your contract with the App Store or Google Play is additionally governed by the terms of that store.

2. What Daynori is

Daynori is an alarm clock with wake-up tasks, sleep sounds and small routines (Dailys). The basic version is free and shows ads. Daynori Pro removes the ads and unlocks further features; the app shows what is included before you buy.

An account is optional. It serves the sync between your devices and the Pro pass.

3. What you can rely on with the alarm

Whether an alarm rings also depends on your device: on volume, battery, focus and system settings, on the permissions granted and on whether the operating system lets the app run. In the settings, the app shows whether your alarm is ready and what is still missing.

If a lot depends on an appointment, such as a flight, an exam or taking medication, set a second alarm as well. Daynori is not a medical device and does not measure sleep.

4. Licence

You receive the non-exclusive, non-transferable right to use Daynori on devices that you own or control, within the usage rules of your store. The software, sounds, images and texts remain our property or that of our licensors. You may not extract them from the app, pass them on or use them outside the app. Statutory rights, for example under Sections 69d and 69e of the German Copyright Act, remain unaffected.

You are responsible yourself for your own audio files that you add as a sound. They stay on your device.

5. Daynori Pro: purchase, term and cancellation

Daynori Pro is available as a subscription with a monthly or yearly term and as a one-time purchase. The price, the term and any introductory price are shown in the offer in the app and in the store before you buy. Where an introductory price applies, the offer states its period and the price after it. The price may differ by country.

The purchase is handled by your store: in the European Economic Area, Apple Distribution International Ltd. for the App Store and Google Commerce Limited for Google Play. You pay through your account with the store. Payment, invoicing and refunds are governed by the store’s terms.

A subscription renews for the chosen term unless you cancel it in good time before it ends, with Apple at least 24 hours before. You cancel in your store’s subscription settings: with Apple at apps.apple.com/account/subscriptions and with Google Play at play.google.com/store/account/subscriptions

After cancellation, Pro stays active until the end of the paid term. Deleting the app or your Daynori account does not cancel a subscription.

The one-time purchase unlocks Pro permanently for your account with the store. You restore purchases in the app under Settings → Restore Pro purchases.

6. Right of withdrawal

As a consumer you generally have a statutory right to withdraw from purchases in the store within 14 days. You exercise it towards the store that handled the purchase; there you also find the withdrawal information and the cases in which the right ends early. With Apple this is done at reportaproblem.apple.com and with Google Play through the refund request in your Google Play account.

7. Pro pass and points

With an account you collect points for Dailys you complete and sync. You can redeem points in the app for days of Daynori Pro; the app shows how many points a pass costs. Points and passes are a voluntary extra: they have no monetary value, are not paid out and cannot be transferred. They lapse when the account is deleted.

A pass is valid for 7, 14 or 30 days. It begins when you redeem it or, if a pass is still running, when that one ends, and it does not renew by itself. While you have purchased Daynori Pro, no pass can be redeemed.

We may change the rules for points for the future or end the collecting. A pass you have redeemed stays valid until it ends. We may remove points that were obtained by manipulation.

8. Your account

You are responsible for who has access to your email inbox and your devices, because that is how you sign in. You can delete your account at any time in the app under Settings → Your account; the steps are also described at daynori.mizustudio.dev/delete-account

If an account is misused, for example to attack our servers or to obtain points by deceit, we may block or delete it.

9. What is not allowed

• attacking or overloading the app or our servers, or circumventing protective measures,
• manipulating points, purchases or unlocks,
• copying sounds or other content out of the app and passing it on,
• sending unlawful content through feedback or the contact form.

10. Children and teenagers

Daynori has no minimum age. Anyone who is not yet of age uses Daynori with the agreement of their parents or guardians. This applies in particular to purchases and to consent to advertising.

11. Updates and changes to the app

We provide the updates that are needed for Daynori to remain in conformity with the contract and announce them through the store. Install them promptly. We are not liable for defects caused solely by the fact that an update we provided was not installed (Section 327f of the German Civil Code).

We may change Daynori where there is a valid reason, such as new requirements from Apple or Google, new operating systems, security, a change in the law or the further development of the app. This costs you nothing. If a change impairs the use of Daynori Pro more than insignificantly, we inform you beforehand; you can then end the contract free of charge within 30 days (Section 327r of the German Civil Code).

If we discontinue Daynori, we announce this with reasonable notice. Your statutory rights remain unaffected.

12. Defects and feedback

The statutory rights for defects in digital products apply (Sections 327 et seq. of the German Civil Code). The easiest way to report a problem is in the app under Settings → Send feedback, or by email.

We may use suggestions and hints you send us to improve Daynori. This creates no claim to their implementation or to payment.

13. Liability

We are liable without limit for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.

For slight negligence we are liable only if we breach an essential duty, that is, a duty whose fulfilment makes the contract possible in the first place and on which you may rely. Liability is then limited to the damage that is typical and foreseeable for a contract of this kind. Otherwise liability for slight negligence is excluded.

14. Apple App Store

If you downloaded Daynori from Apple’s App Store, the following applies in addition:

• These terms are concluded between you and us only, not with Apple. We alone, not Apple, are responsible for Daynori and its content.
• Your licence is non-transferable and covers Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts may use Daynori through Family Sharing or volume purchasing.
• We alone provide maintenance and support. Apple has no obligation to do so.
• We alone are responsible for any warranty. If Daynori fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. Beyond that, to the maximum extent permitted by law, Apple has no warranty obligation for Daynori.
• Claims by you or third parties relating to Daynori are addressed to us, not to Apple. This includes product liability claims, claims that Daynori fails to conform to a legal or regulatory requirement, and claims under consumer protection or privacy law.
• If a third party claims that Daynori infringes its intellectual property rights, we alone, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
• When using Daynori you comply with the third-party terms that apply to you, for example those of your mobile contract.
• Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept the terms, Apple has the right to enforce them against you as a third-party beneficiary.
• Questions, complaints and claims about Daynori go to the address, email address or phone number in section 1.

15. Google Play

If you downloaded Daynori from Google Play, purchase and payment are additionally governed by the Google Play Terms of Service.

16. Changes to these terms

We may adapt these terms for the future where there is an objective reason, such as new features, new requirements from the stores or a change in the law. The current version is on this page with its date; we announce material changes in the app. Changes that shift the balance between what you get and what you pay to your disadvantage apply only with your consent.

17. Law, dispute resolution and language

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you live in another country as a consumer, you keep the protection of the mandatory provisions of the country where you habitually reside.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

If the language versions differ, the German version applies. Should a provision be invalid, the others remain in force.
